PROBATE CASE MANAGEMENT CONFERENCE CALENDAR – TENTATIVE RULINGS

PLEASE NOTE:  Masks need not be worn in the courthouse if you are fully vaccinated.

Persons are considered vaccinated two weeks after the final dose in a primary series of vaccinations.

All unvaccinated persons entering any Sonoma County Superior Courthouse, including any remote jury selection location, shall wear a face covering at all times compliant with all California State Health Orders and CAL/OSHA standards which must completely cover both the nose and mouth. 

 

Court Call is not permitted for this calendar.

 

ADVISEMENTS:
The tentative rulings set forth below are those of a temporary judge assigned by the Presiding Judge to hear all matters on this calendar.  (Rules 2.810-2.819 of CRC)  If the tentative ruling is accepted, no appearance is necessary unless otherwise indicated. 
 
Any interested party who does not wish his/her/its/their matter to be determined by a temporary judge or who otherwise wishes to be heard in response to the tentative ruling must do the following:  

1) notify all other parties of an intent to appear for the purpose of responding to the tentative ruling or to request a continuance to a date when the matter may be heard by the judicial officer regularly assigned to hear probate matters; and
 
2) notify the probate clerk at (707) 521-6893 of an intent to appear to respond to the tentative ruling or to request a continuance to a date when the matter may be heard by the judicial officer regularly assigned to hear probate matters.  You must inform the clerk whether appearance will be via Zoom or in person. 
 
Both notifications must be completed no later than 4:00 p.m. on the court day immediately preceding the day of the hearing.  Failure to provide both notifications will be deemed an agreement to the adoption of the tentative ruling by the temporary judge.  

 

Unless notification to the probate clerk has been given as provided above, the tentative rulings shall become the rulings of the court at the time of the hearing.

Guide for participating in court proceedings via Zoom for Department 23.

 

  • After joining the meeting and checking in with the clerk, please mute your audio when not speaking. This helps keep background noise to a minimum.

 

  • Be mindful of background noise when your microphone is not muted. Avoid activities that could create additional noise, such as shuffling papers.

 

  • Position your camera properly if you choose to use a web camera. Be sure it is in a stable position and focused at eye level, if possible. Make sure everything visible in the frame is appropriate for an appearance in court.

 

  • If a confidential session becomes necessary, it is incumbent on you to ensure you are able to participate from a private location so that unauthorized people cannot overhear or see the proceedings.

 

  • Chat is enabled for the sharing of documents among participants and the court and to allow attorneys to communicate individually with each other or their clients only. No chat messages should be sent privately to the court as it would amount to an unauthorized ex parte communication. Neither should chat messages be sent to all participants unless directed by the court.

 

  • The recording function has been disabled. Remember, the prohibition against recording court proceedings, even remote ones, remains.

 

  • Be patient. Check in will take more time and the experience from those who have tried this before is that proceedings are a little slower generally.

Tentative Ruling: APPEARANCES REQUIRED to update the Court re the filing of the First Account and Report of Conservator.
 


 
2.    In re the Estate of Dorothy Parker, SPR095046
 
Tentative Ruling:   NO APPEARANCES REQUIRED. The Court is satisfied the administration of this Estate is progressing in an orderly fashion. Case is already set for further CMC on 9/29/2022 to ensure the filing of appropriate receipts showing estate assets have been delivered to the entitled persons (Prob. Code § 12250) and a Petition for Final Discharge (Prob. Code § 11753). If the same have been filed in advance of the continued hearing date, appearance for 9/29 will be waived.

Tentative Ruling: APPEARANCES REQUIRED to provide the Court with the status of the estate or final account and distribution.

Tentative Ruling: NO APPEARANCE REQUIRED. This matter is CONTINUED to 3:00 p.m. on December 8, 2022, in Department 23 for further CMC for waiver of account and final distribution. The Court is satisfied the administration of this Estate is progressing in an orderly fashion.
 


 
6.    In re the Matter of the Sidney Terrell Trust, SPR095586
 
Tentative Ruling: This matter is DROPPED from calendar. Dismissal filed on March 16, 2022.
 


 
7.    In re the Estate of Alfred Fambrini Trust, SPR096348
 
Tentative Ruling:  In the absence of objections or opposition, the Petition filed on February 1, 2022, is APPROVED. The Court will sign the proposed order submitted with the Petition.
