NOTICE RE: COURT TRIALS -

You are receiving this notice because you presently have a court trial set in Department 17 during December 2020 and January 2021. In light of the need to protect public health and safety as a result of the Covid-19 pandemic there has been a significant interference with the Superior Court services and proceedings.  The Civil Courthouse remains closed to the public presently with no plans to re-open during January 2021. As a result, the court makes the following orders with regard to court trials set in December 2020 and January 2021.

ALL CIVIL COURT TRIALS REMAIN AS SET DECEMBER 2020 THROUGH JANUARY 2021. The court’s ability to conduct a court trial set in December and January will be limited to trials conducted by remote appearance (via Zoom) only. All parties/counsel are ordered to meet and confer upon receipt of this notice about whether: 1) all parties agree to a trial via Zoom; 2) if so, how they propose to exchange and submit exhibits to the court; 3) whether all witnesses and exhibits will be available for presentation via Zoom; and 4) any other issues raised in their particular case if trial is to be held via Zoom. Each party is directed to file and serve a short, informal status update with the court at least 2 calendars days prior to their Friday, 8:30 a.m. trial call date addressing each of the above items. You must appear on the presently scheduled Friday, 8:30 a.m. calendar date to discuss whether the parties agree to a trial via Zoom and procedurally how the matter will proceed. If there is not unanimous consent to a trial via Zoom, or the case is not conducive to trial via Zoom, the court will discuss with the parties a new trial date and possible extension of the discovery cut-off date.

YOU ARE HEREBY FURTHER NOTIFIED THAT counsel and self-represented litigants are NOT REQUIRED to file trial documents at this time as set forth in the Trial Orders of the Court and in our Local Rules.

All appearances at the Friday, 8:30 a.m. trial call shall be via Zoom only. No in person appearances are permitted.
