Tentative Rulings

Wednesday, April 23, 2025  3:00 p.m.

4/23 CHANGE OF NAME CALENDAR/6362

Change of Name or Gender

1.         PETITION OF ADOLFO MENDOZA, FRANCISCA ORTEGA CARRANZA

            25CV00423

TENTATIVE RULING: Petitioners previously requested, and the Court granted, a continuation of the 03/26/25 hearing to allow for publication to take place. As of the present date, Petitioners have not filed a Proof of Service showing that publication has been completed. The matter is continued to 05/14/25 at 3:00 p.m. in Department 19 to allow petitioner time to file proof that a copy of the Order to Show Cause was published in a local newspaper as required by Code of Civil Procedure section 1277(a)(2). Petitioner must obtain an amended OSC with the new hearing date for purposes of publication. If petitioner has proper proof of publication, they may file it with the court and request to appear at the hearing. Additionally, the Court notes that the Petition we originally filed in part by Adolfo Mendoza and now an Adolfo Mendoza Mendoza is being identified in all paperwork. The Court will require proof of identification to ensure the original petitioning party, and the newly identified individual are one and the same. Petitioners are to cure these defects prior to the next hearing date or risk the Petition being denied.

2.         PETITION OF DAVID DOMENICHELLI

            25CV00915

TENTATIVE RULING: In-Person Appearance Required.

3.         PETITION OF KATHERINE DOWDALL-CERUTI

            25CV01027

TENTATIVE RULING: No Appearance is Required. The Court finds that Petitioner Katherine Marie Dowdall-Ceruti has complied with all prerequisites outlined under California Code of Civil procedure (“C.C.P.”) §1277 for a Petition for Change of Name. The Court finds that no timely objection has been filed against said Petition. Therefore, the Court now GRANTS the Petitioner’s Decree Changing Name of “Katherine Marie Dowdall-Ceruti” to “Katherine Marie Dowdall”.
